Sometimes they just don't pay for the testing for under 3 to get the "safe under 3" label so they had to put the choking hazard warning.

Sure, I don't see why not. It's a plastic toy and I expect all of the pieces except the bottom (green) ball, which is weighted, will float.

I'm pretty sure there is not any liquid in the largest piece. This is a phenomenal toy. My granddaughter has played with it from age 1 to age 5. An ingenious toy. Buy it - your child will love it.
